The sequence of the Ljungan virus is protected, along with its uses in future prophylactic treatments (vaccines) against diabetes, heart disorders and a multitude of other disorders and illnesses.

Two other derived applications have recently been filed to USPTO (7. Jun. 2006 and 29. Jun. 2006)

The applicant in Europe was originally the Swedish company Microtus AB , then Nya Apodemus AB and now Apodemus AB.

In USA the applicant is always the inventor(s); in this case Niklasson.

Seek to protect the use of diabetic bank voles as a new animal model for type 1 diabetes in addition to the use of a general method to facilitate the development of diabetes. The method consists in subjecting any mammal-based animal model to "stress" by keeping it in a cage (excisting animal models will probably fall under the claims too).
Apparently the EU patent covers the use of diabetic bank voles regardless of any previous infection and, second, the use of Ljungan virus infected voles. The US patent appears to solely cover a diabetic model resulting of a combination of "stress" and infection with a Ljungan virus.

The applicant in Europe is the Swedish company Apodemus AB.

In USA the applicant is Niklasson and Lernmark

12 of 14 claims in the EU patent can be directly attributed in full, or in part, to the inventions made by three omitted Danish inventors. The inventions made way prior to any collaboration with the official Swedish inventors are:

1) Bank voles can develop diabetes mellitus as a result of the stress related to captivity.

2) Stress can modulate the proneness to develop diabetes in our bank vole model and, by inference, perhaps in any animal model of diabetes.

The use of the antiviral medicament PLECONARIL, or a derivate thereof, to treat a multitude of possible Ljungan virus induced illnesses. 14 claims in total (EU).

In the American application there is at present 19 claims where the first 14 in effect is similar to the European application. The last five claims specify that the preferred method to treat this Ljungan infection include treatment with antiserum (based on Ljungan virus antibodies) and Interferon, wherein said interferon includes .alpha..

The applicant in Europe is the Swedish company Apodemus AB.

In USA the applicant is Niklasson.

 

 

Note A (regarding patent base):
The basis for a patent application is, in some instances, a draft of what later is published as a scientific paper.
